Please review carefully. This notice explains how ABC Discount Pharmacy may use and share your protected health information (PHI), how you can obtain information about it, and the privacy rights available to you. It concerns pharmacy records, not merely browsing this website.
Your privacy rights
- Access: Request inspection or a paper or electronic copy of eligible health records. We generally respond within 30 days, subject to HIPAA requirements and permitted extensions. Reasonable cost-based fees may apply.
- Corrections: Ask us to amend inaccurate or incomplete information. We will explain a denial in writing when applicable.
- Confidential contact: Ask us to communicate at another address or through a reasonable alternative method.
- Restrictions: Ask us to limit certain uses or disclosures. Some requests are discretionary; a qualifying request to withhold information from a health plan about a service paid entirely out of pocket must generally be honored unless law requires disclosure.
- Accounting: Request a record of certain disclosures as provided by HIPAA.
- Paper notice and representatives: Ask for a paper copy of this notice and, where authorized, have a personal representative exercise your rights.
- Complaints: Raise privacy concerns with our designated privacy contact or the U.S. Department of Health and Human Services Office for Civil Rights (OCR). We will not retaliate against you for filing a complaint.
How we may use or share information
Subject to applicable law, we may use or disclose PHI for treatment (such as coordinating prescriptions with prescribers and other pharmacies), payment (such as processing claims), and healthcare operations (such as quality assurance, audits, and administration). We may also share information as allowed or required for public health and safety, health oversight, legal compliance, certain research activities, coroners or medical examiners, workers' compensation, and appropriately authorized court or law-enforcement processes.
We may communicate with people involved in your care or payment when allowed under applicable privacy rules and consistent with your preferences. Certain disclosures—such as many marketing uses, sales of PHI, and most disclosures of psychotherapy notes—generally require written authorization. You may revoke an authorization prospectively, subject to legal limits.
Special protection for substance use disorder records
Some substance use disorder treatment records may be subject to additional confidentiality protections under 42 CFR Part 2. If we receive or maintain records subject to those rules, special limits may apply to their use in civil, criminal, administrative, or legislative proceedings against a patient, and additional notice, consent, redisclosure, or fundraising requirements may apply. We apply any additional protections required when handling such records.
Our responsibilities
- Protect the privacy and security of PHI as required by law.
- Provide notifications of breaches when required.
- Follow the terms of the notice currently in effect and provide copies upon request.
- Use or share information outside the described or legally permitted purposes only with an appropriate authorization, where required.
Changes to this notice
We may revise our privacy practices and this notice as permitted by law. The updated notice will be available at the pharmacy and on this website. Material revisions will be communicated as required.
